This Hair & Makeup Services Agreement and Binding Liability Waiver (the "Agreement") is entered into as of the Session Date set forth above by and between the Client identified above ("Client") and [YOUR_STUDIO_NAME] LLC, a Pennsylvania limited liability company ("Studio"). By signing below, Client acknowledges that they have read, understood, and voluntarily agreed to be legally bound by every term, condition, waiver, and release contained herein.

SECTION 1|Independent Contractor Acknowledgment

The Client expressly acknowledges and agrees that all hair and makeup services contemplated under this Agreement are performed solely by Emily Houck of Glammed by Emily (the "Artist"), who operates as an independent contractor. The Artist is not an employee, agent, partner, joint venturer, representative, or affiliate of [YOUR_STUDIO_NAME] LLC in any capacity whatsoever. The Studio does not direct, supervise, train, certify, license, approve, endorse, or guarantee the Artist's professional methods, product selections, sanitation practices, hygiene protocols, techniques, or end results. The Artist retains complete and exclusive control over all tools, materials, products, equipment, and artistic decisions used in providing services.

The Studio's sole role is the provision of physical workspace. The Client agrees that [YOUR_STUDIO_NAME] LLC, its owners, members, officers, employees, contractors, successors, and assigns shall not be held liable, in whole or in part, for any outcome, reaction, dispute, injury, loss, damage, or dissatisfaction arising out of or relating to hair or makeup services rendered. All questions, complaints, billing matters, refund requests, and service-related concerns must be directed exclusively to the Artist at glammedbyemily@gmail.com.

SECTION 2|Allergy Disclosure & Sensitivity Information

A.  Hair & Makeup Product Allergies or Sensitivities

Does the Client have any known allergies or sensitivities to hair and/or makeup products?

The Client expressly acknowledges that any failure to disclose allergies or sensitivities — whether known, suspected, historical, recently developed, or arising from any source — directly places the Client at risk of harm. The Client assumes full and exclusive responsibility for all reactions, injuries, conditions, or consequences resulting from incomplete, omitted, or inaccurate disclosure.

The Client understands and agrees that while the Artist will use reasonable efforts to avoid known disclosed allergens, complete elimination of allergen exposure cannot be guaranteed. Exposure may occur through trace residue from shared kits, airborne particles, environmental transfer, or other unavoidable means. The Client assumes all medical, financial, and personal responsibility for any reaction, including emergency care, hospitalization, prescription medication, follow-up treatment, and any long-term, recurring, or latent effects.

SECTION 3|Assumption of Risk & Waiver of Liability

The Client expressly acknowledges that hair and makeup services involve inherent and unavoidable risks, including but not limited to: allergic reactions; contact dermatitis; redness, swelling, or irritation; sensitivity to adhesives, fragrances, or pigments; lash adhesive reactions; eye injury or discomfort; chemical burns; breakouts; folliculitis; skin or scalp irritation; bacterial, viral, or fungal infection; and heat-related hair damage including breakage or scalp burns. Reactions may occur even if the Client has never previously reacted to similar products or has tolerated them in the past.

By proceeding with services, the Client knowingly, voluntarily, and irrevocably assumes full responsibility for all risks, outcomes, and consequences — whether immediate, delayed, latent, recurrent, or permanent. The Client agrees that neither the Artist nor [YOUR_STUDIO_NAME] LLC may be held liable, jointly or severally, for any physical, medical, psychological, emotional, financial, or aesthetic effects resulting from the session. This assumption of risk and waiver is binding upon the Client, their heirs, executors, administrators, personal representatives, successors, assigns, and any party acting on the Client's behalf.

SECTION 4|Indemnification & Release of Liability

To the fullest extent permitted by law, the Client agrees to release, waive, discharge, defend, indemnify, and hold harmless the Artist and [YOUR_STUDIO_NAME] LLC, together with their respective owners, members, officers, employees, contractors, agents, insurers, successors, and assigns (collectively, the "Released Parties"), from any and all claims, demands, causes of action, damages, losses, liabilities, judgments, settlements, costs, expenses, and attorney's fees — whether known or unknown, anticipated or unanticipated, in law or in equity — arising out of or relating to:

• Services performed under this Agreement;
• Allergic reactions of any kind, whether previously known or unknown to the Client;
• The Client's failure to disclose, accurately or completely, any medical condition, allergy, sensitivity, medication, or relevant history;
• Sensitivity, intolerance, or adverse response to any product, tool, implement, or technique;
• Personal dissatisfaction with the artistic, aesthetic, or stylistic results of the services.

This release and indemnification applies regardless of any contributing or concurrent factors, regardless of the timing of the reaction or injury, and regardless of whether the claim is asserted under contract, tort, strict liability, statute, or any other legal theory.

SECTION 5|Limitation of Liability

All liability for hair and makeup services rests solely and exclusively with the Artist. [YOUR_STUDIO_NAME] LLC bears no responsibility — direct, indirect, vicarious, or otherwise — for any reaction, condition, dissatisfaction, injury, or harm related to services rendered or products used by the Artist.

Results, longevity, color match, hold, and overall finish cannot be guaranteed and may vary due to individual skin chemistry, hair texture, hormonal factors, environmental conditions, photographic lighting, product interaction, and personal handling after the session. Any monetary claim for damages permitted under this Agreement is strictly capped at the amount paid by the Client directly to the Artist for the specific services giving rise to the claim. Under no circumstances shall the Released Parties be liable for any consequential, incidental, indirect, special, exemplary, emotional, or punitive damages.

SECTION 6|Governing Law, Venue & Binding Arbitration

This Agreement shall be governed by, construed under, and enforced in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any and all disputes, controversies, or claims arising out of or relating to this Agreement, the services rendered, or the relationship between the parties shall be resolved exclusively through final and binding arbitration administered in Franklin County, Pennsylvania, in accordance with the rules of the American Arbitration Association then in effect.

THE CLIENT EXPRESSLY WAIVES THE RIGHT TO A TRIAL BY COURT, THE RIGHT TO A TRIAL BY JURY, AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The decision of the arbitrator shall be final, non-appealable, and enforceable in any court of competent jurisdiction. Each party shall bear its own attorney's fees and costs unless otherwise required by applicable law or awarded by the arbitrator.

SECTION 7|Severability, Entire Agreement & Survival

If any provision of this Agreement is held invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to render it enforceable, or shall be severed from this Agreement. All remaining provisions shall continue in full force and effect. This Agreement constitutes the entire understanding between the parties and supersedes all prior or contemporaneous agreements. The waivers, releases, indemnification obligations, and limitations of liability contained herein shall survive the completion, expiration, or termination of services.

SECTION 8|Acknowledgment & Agreement

By signing below, the Client knowingly, voluntarily, and unequivocally confirms each of the following:

• They have read this Agreement in its entirety and have had ample opportunity to ask questions and seek independent legal counsel before signing;
• They fully understand all risks, disclosures, waivers, releases, indemnification obligations, and limitations of liability set forth herein;
• They have provided complete, accurate, and truthful allergy and medical disclosure information;
• They voluntarily agree to all waivers, releases, limitations, arbitration provisions, and other legal terms contained in this Agreement;
• This Agreement remains valid and enforceable for the session listed above and for all future sessions with the Studio and the Artist unless and until expressly replaced in writing signed by both parties.
